Texas now regulates BWCs primarily through CCP Article 2B (as amended by HB 4504, 2023) rather than solely through the Occupations Code. BWCs are not automatically public under the Texas Public Information Act; instead, BWCs are handled under 2B with a structured release process: agencies must adopt a BWC policy (activation, retention, storage, privacy, and public access guidelines; retention minimum of 90 days); BWCs may be released publicly only under the Public Information Act with redactions as appropriate, and information that could be used as evidence in a criminal case remains subject to 552.021 (public information law) and related exemptions. Requesters must include date/time, location, and subject name; if not included, the agency may still allow future requests. Agencies may redact information or withhold under 552 exemptions such as confidential information and law-enforcement information; there is a defined AG decision process (2B.0113) and a voluminous-request process (2B.0114). Fees for copies are set by AG; the Open Records Handbook provides procedure guidance. Release deadline
