On May 14, the victim called the JSO communications center to report Delay had become violent with her. The victim said Delay was heavily intoxicated. The victim and Delay share a baby who was present for his behavior. When officers arrived on scene, Delay had already left. The officers spoke to the visibly injured victim and planned to seek an arrest warrant for Delay. Well after the officers had left, Delay returned to the house, still intoxicated. He armed himself with a handgun and held the victim against her will inside a bedroom. At one point, Delay pointed the gun at the victim and told her he would kill her if she tried to leave. Delay also made threats to “shoot everyone” if she called the police. Delay left the bedroom, armed himself with multiple firearms, including a rifle, and fired multiple rounds in the front yard. The victim ran from the house into the yard, carrying her baby, and placed an emergency call to report Delay’s violent behavior. Officers arrived on scene and located the victim and baby. While Officer Comayagua was taking the baby from the victim, Delay came into the yard, armed with a handgun. Delay threatened he would kill the victim before raising his gun at the victim and officers. Officer Comayagua, who was still holding the baby, and Officer Jones fired at Delay, striking him. Delay ran, and other responding officers took him into custody. He was then taken to a hospital where he is in stable condition. The State Attorney’s Office will independently review the incident to assess the legality of the officers’ actions. JSO will then conduct an internal review to ensure the officers acted within policy. Conclusions remain pending.
